Surprise, disappointment from local BCTF reps after Court of Appeal sides with gov’t

Premier Christy Clark, and her education minister are holding out an olive branch to teachers after today’s BC Court of Appeal ruling on class size and composition.

But it doesn’t look like the BCTF will take it.

The 4-1 decision overturns a lower court ruling that the government violated the Charter with legislation that took class size and composition OUT of collective bargaining.

Clark says this is a chance to build on the recent contract.

The BCTF, however, says it wants to take the case to the Supreme Court.

Teachers’ association presidents in this area say they were a bit surprised at the ruling… but think the dissenting opinion gives them a strong case for a Supreme Court challenge.

Mike Ball is president of the Nanaimo District Teachers Association.

Those thoughts are echoed by Sunshine Coast Teachers Association president Louise Herle.

The BCTF has 60 days to file its challenge with the Supreme Court. However, there’s not guarantee the high court will agree to hear it.
