Conditional sentences for Maybin brothers

Two Nanaimo brothers who pleaded guilty to charges of manslaughter and assault causing bodily harm in the death of a man in 2006 have escaped jail time.

Timothy and Matthew Maybin pleaded guilty earlier this month to their roles in the death of 20-year-old Michael Brophy, who died after a fight at the now-closed Grizzly B’ar in Nanaimo.

The Crown was asking for a sentence of 2 years less a day for Timothy for manslaughter and 6 to 12 months for Matthew for assault causing bodily harm.

Timothy has been handed a 2 year conditional sentence and Matthew is facing an 8 month conditional sentence. Both will face some strict conditions and are banned from owning firearms for 10 years.

Meanwhile, Buddha Gains has pleaded guilty to assault causing bodily harm. Gains was working as a bouncer at the bar on the night Brophy died. He will be sentenced May 26th. The Crown is seeking up to 12 months in jail for Gains’ role in Brophy’s death.
