Arguments are underway in a Vancouver courtroom as a Vancouver Island RCMP officer tries to get a conviction on aggravated assault overturned.
Constable Dave Pompeo was sentenced last December to probation and community service in the 2009 shooting of Bill Gillespie of Chemainus. The incident happened during a routine traffic stop.
At the time the RCMP refused to speculate on possible internal discipline, pending the appeal.
Pompeo is currently with the Nanaimo detachment.
The Court of Appeal has set aside 2 days to hear the case.
